ARTO Kargil notifies to register BS-IV vehicles by April 1, 2020

Assistant Regional Transport Officer (ARTO), Kargil informs applicants of Kargil district who have purchased BS-IV vehicles to get it registered in the office of the Assistant Regional Transport Officer, Kargil before April 1, 2020.

ARTO Kargil shall not be responsible for the registration of BS-IV Motor Vehicles after the said deadline set by the Supreme Court of India.

The notification was issued according to the judgment passed by the Supreme Court of India on October 24, 2018, the registration of BS-IV vehicles has been banned w.e.f; 01-04-2020. 

The notice further reads that the Supreme Court has observed that there can be no two views that air pollution is hazardous to health. The report of the committee constituted shows that one out of three children in Delhi suffers from respiratory problems. It may be noted that the World Health Organization (WHO) database of more than 4,300 cities showed Indian cities of Gwalior, Ahmadabad, Raipur, Delhi, Ludhiana, Varanasi and Patna as being among the most polluted in the world.

The hazard of pollution and its ill effects on the health of the citizens especially children are not limited to the city of Delhi or NCR of Delhi but affect all the citizens of the country. India has the dubious distinction of having 15 out of the 20 most polluted cities in the world. The situation is alarming. It has been also felt that the right to clean environment is a fundamental right. The right to live in an environment free from smoke and pollution follows from the “quality” of life which is an inherent part of Article 21 of the Constitution. The right to life not only means leading a life with dignity but includes within its ambit the right to lead a healthy and robust life in a clean atmosphere free from pollution.

Therefore, Supreme Court of India, passed a judgment, in exercise of the power vested under Article 142 of the Constitution, read down sub-rule 21 of Rules 115 and direct that sub-rule 21 of rule 115 shall be interpreted and understood to read that no motor vehicle conforming to the emission standard Bharat Stage IV shall be sold or registered in the entire country with effect from 01-04-2020.

Accordingly, applicants of the Kargil district are informed to ensure that the instructions are implemented in letter and spirit.
