6th LAHDC,Leh election: Model Code of Conduct comes into effect

Election Authority for Elections to the 6th LAHDC/ District Magistrate, Leh Sachin Kumar Vaishya issued an order regarding enforcement of on September 19.

The order reads as; whereas, notification for the election to the 6th Ladakh Autonomous Hill Development Council (LAHDC), Leh has been issued by the Administration of Union Territory of Ladakh vide S.O. No.: 27 dated 18-09-2020; and, 16-10-2020 has been fixed as the Poll Day. 
                             
Whereas, consequent upon the said notification, the Election Authority for the 6th LAHDC, Leh, do hereby enforce the Model Code of Conduct (MCC) immediately; and, therefore, it is now mandatory for all political parties as well as for the independent candidates to follow the MCC in letter and spirit till the election process is over.
 
Whereas, consequent upon the enforcement of the MCC, mandatory to obtain prior permission for organizing meetings and rallies by the political parties and the independent candidates. Prior permission shall also be mandatory for using motor vehicles for all kinds of campaigning/electioneering purposes. The permission in prescribed format should be displayed on the windshield of the vehicles for information of the election authorities.
  
1. No rallies/public meetings of a political nature shall be permitted in the district without prior permission. For organising any rally/public meeting, permission has to be obtained and the same shall have to be produced for inspection on demand by Officers/Official on election duty like Magistrates and Police Officers/Personnel at the venue of the rallies/public meetings. 
 
2. No vehicles shall be used for Electioneering/Campaigning, Loud announcement without the prior permission. The permission obtained shall be displayed on the windshield of the four-wheeler in such a way so that the same is visible to the authorities. For two wheelers, such permissions need not be displayed but should be produced on demand for inspection. In addition, no official vehicle shall also be used for electioneering/campaigning.
 
3. Public premises and government structures like buildings, electric poles, road dividers etc shall not be defaced by posters, flags and banners; and, private structures shall be used only with the prior consent of the owners.
 
4. Non-biodegradable material like plastic, polythene etc. shall not be used for any kind of electioneering/campaigning activities.
 
5. Loud announcements shall not be carried out without prior permission; and, in no case, this would be allowed in the vicinity of schools, hospitals and old age homes. Under no circumstances, announcements shall be allowed before 10:00 am and after 6:00 pm.
 
6. Liquor, Cash, Food and consumer goods shall not be distributed by any organization/Political Parties, Independent Candidates etc. in any case. This shall apply to Non-Governmental Organizations also.
 
7. The registered/licensed liquor shops shall inform the Magistrate concerned, Excise and Police authorities about their daily sales of liquor; and, bulk sales shall be specially brought immediately to the notice of the authorities. The Magistrates on duty and the State Tax officer, with the assistance of the police, shall take stringent legal action against all un-registered/unlicensed Bars/Liquor shops immediately and submit action taken report to the undersigned on daily basis after the issuance of this order.
 
8. Broad guidelines (enclosed) for conduct of the 6th LAHDC Elections by the undersigned vis-à-vis COVID-19 and SOPS/Guidelines issued by the MHA, Gol from time to time shall have to be followed in letter and spirit during the entire election process.
 
This order shall be in force in the whole of Leh district till the 6th LAHDC elections are over and shall be enforced in letter and spirit by all Magistrates, enforcement agencies and they shall have the authority to seize any vehicle and stop any rally/procession if it is found that they are in contravention to this order or to the MCC.
